Talk about the Green New Deal, not this Senate vote

Let’s get one thing clear about this week’s Senate vote on a Green New Deal: Mitch McConnell is a twerp.

The resolution that was voted on this week was not the non-binding Green New Deal resolution introduced by Sen. Edward Markey (D-Mass.) and Rep. Alexandria Ocasio-Cortez (D-N.Y.), which we’ve talked. a lot. about.

That resolution would need to be referred to committee, where it would have committee hearings and consideration and debate – the kind of stuff that might address the concerns we and others have raised about banning fossil fuels, stopping pipelines, and the like. It also would give time and space to fill in details that are missing.

McConnell doesn’t want that debate, so he introduced this binding resolution making “it is the sense of the Senate” that the Green New Deal should become “the policy of the United States.” Like I said, he’s a twerp.

But Whatever McConnell’s shady motivations, this week’s vote was a slap-in-the-face loss to the climate community. The vote was 57-to-0, with 4 Dems, 1 Independent and every Republican voting “no” and all other dems voting “present.”

That’s especially galling because the oil, gas, & coal industries contributed more than $55 MILLION to senators who voted “no” on the #GreenNewDeal resolution – 11x more than to those who voted “present”.

It’s also hard to swallow because after 3 months of a new Congress, thousands of media stories, hundreds of lobby visits, sit ins, protests, and press conference galore we’ve actually managed to convince a majority of Americans that this is a crisis worth tackling – and tackling this way.

Which is why I’m sticking to my guns on this 198-methods strategy: We need outside action, especially direct action, that slows or stops the buildout of fossil fuel infrastructure. AND we need an inside-strategy that presses politicians and regulators to take actions (like a real, fossil-free, Green New Deal), because only big policy solutions will change the dynamic fast enough.

What’s the big deal?

Don’t get me wrong, the Green New Deal has re-shaped the debate on climate change and gotten politicians to talk about the scope and severity of the crisis in a serious way for the first time in a long time.

But the conversation is still stuck in false assumptions that will not keep fossil fuels in the ground or address the systemic racism and injustice of sacrifice zones. In the House of Representatives (outside Mitch the twerp-turtle’s jurisdiction), at least 3 committees are considering climate legislation. But all those bills, and even the actual resolution from Markey and AOC still talk about “net zero emissions” or set the timeline to end fossil fuels and nuclear power way too far in the future (like 2050 or later).

And I’m not just being a stick-in-the-mud: The decision to leave fossil fuels and nuclear on the table in the Green new Deal is shaping the 2020 conversation already: Beto O’Rourke said he supports a Green New Deal, and fracked gas, when Friends of the Earth questioned him in New Hampshire. A few days later, Sen Cory Booker said “I already support the Green New Deal. This resolution of bold vision is what we need. … And I agree with you. Nuclear has to be part of this solution.”

As a side-note, Booker was at a South Carolina town hall meeting organized by CNN that night. If he’d read the local paper, he might have seen that a few miles away another nuclear waste site was caught leaking tritium into the ground water in Barnwell, SC.

If we leave fossil fuels and nuclear on the table, what we’re really saying is that we’re ok with sacrifice zones. Because if we don’t start phasing out dirty energy NOW then they will keep building them, and people will keep getting sick, having their land stolen, and worse.

The 5 biggest oil companies (BP, Exxon, Shell etc) are planning to spend $110 BILLION on new oil & gas projects THIS YEAR (2019) & just 3% as much on clean alternatives.

Wall Street, the fossil fuel companies, the utilities, every single Republican in the Senate and a shockingly large number Democrats are committed to that same vision: another 20-50 years of drilling, spilling, pipelines, genocide, and ecological devastation.

So, now what?

The Senate vote was a sham and a stunt — not least of all because it distracted everyone (effectively) from the real action in the House where this week Nancy Pelosi introduced HR 9 . to keep the US in the Paris climate agreement.

Paris is not a panacea — It’s non-binding, like the AOC/Markey resolution. But it creates a framework to debate bills that have a lot more force and effect.

It’s like agreeing on the playing field, the rules, and saying that we’re in the game. We still need to do all the things to win (in this case stop climate change before it kills us all). And none of that will be possible if we slash our own achilles’ tendons — which is what building 12 new gas export facilities, millions of acres of fracking and drilling rigs, and millions of miles of new pipelines would do to our chances.

But, it’s a start. So this April we’re encouraging you to work on those two tracks: You can join a local Promise to Protect training stop and learn how you can turn up to stop the Keystone Pipeline, and stay tuned for updates on other actions targeting Dominion and the Atlantic Coast Pipeline. At the same time, keep the pressure on Congress to keep debating climate solutions, and make sure they #KeepItInTheGround and say #nonukes as part of those solutions. A great action this week is to call your Senators and tell them to oppose Trump’s choice to lead the Interior Department, David Bernhardt, a former oil lobbyist who is exactly as corrupt as you think he is.

UPDATE – Quick update – Andrew Wheeler, Trump’s climate-destroying nominee to lead the EPA is on the Senate calendar today for a so-called “unanimous consent” vote. Within the last few weeks, Wheeler also said that the Green New Deal would threaten the entire electric grid – belying both a failure to understand how Renewable Energy works, and willingness to lie to the press in service of the Trump administration and the coal industry

You remember Andrew Wheeler, Trump’s climate-destroying nominee to be the permanent head of the EPA? Well he’s about to get a vote in the full Senate.

I’m not going to lie, it’s incredibly unlikely we can stop Wheeler from being confirmed by the full Senate this week. He was passed out of committee last week on a party line votewhich you helped make possible with calls, emails and action demanding that the Committee Shutdown Wheeler, not the EPA in January. And our outspoken advocacy with Friends of the Earth, already got me and my sister arrested while trying to tell Senators about Wheeler’s crimes.

But there’s another really good reason to call your Senator now: Last year, we convinced every Senate Democrat to vote against a Trump nominee for FERC. If we can repeat that this week with a vote on Wheeler, we’ll send a powerful message that confirming Trump’s nominees to key posts on energy and environment is a climate crime. And when it comes time to prosecute the Trump team for their corruption, collusion with polluters, and criminal neglect of our climate: this will be important.

Wheeler, you might remember, has spent most of his life as a lobbyist for the coal industry, most recently for infamous coal-baron Bob Murray. And in the few months he’s been “acting” EPA administrator, he’s stopped at nothing to put fossil fuel profits ahead of public health and the health of the planet.

While he hasn’t committed the kind of outrageous, headline-grabbing scandals Pruitt was known for, Wheeler is an even bigger danger. In just a few months he’s undermined a critical rule that protects us from Mercury pollution – called the Mercury and Air Toxics Standards (MATS). Mercury, usually emitted from coal burning power plants, is a dangerous neurotoxin that’s especially dangerous for children and pregnant women. Wheeler also rolled back regulations on the super-potent climate-changing chemical hydrofluorocarbons (HFCs)And, perhaps most damning, he’s pushed to ease restrictions on the pesticide chlorpyrifos, and the paint stripper methylene chloride — overruling doctors and scientists who spent years proving that they kill farmworkers, contractors and other workers.

What happened with Dominion Power in South Carolina

On Friday, December 14, the South Carolina Public Service Commission (SC-PSC) held a hearing to approve Dominion Power’s proposal to buy our largest utility, SCE&G and its parent company SCANA. As we wrote just before, it was a bad deal for the people of South Carolina, and for the environment and climate we all share.

The SC-PSC and Dominion thought South Carolina was whipped. After years of fighting the VC Summer plant, paying the highest electricity bills in the country, and living with corporate polluters — they  didn’t imagine anyone would show up to oppose them as they stole a little more, wrecked a few more communities, and continued to ignore the climate crisis.

We proved them wrongwe showed up with a team of half-a-dozen activists from South Carolina and North Carolina and took the hearing by storm. We stood up and shouted until they had to adjourn. When a PSC commissioner came out and asked us to be quiet — because he said he was undecided, and wanted to vote on a plan to add solar power to Dominion’s offer — we shouted louder until the threw us out of  the building into the rain and threatened to arrest us. That commissioner, by the way, went back inside, lost every vote to add solar or accountability to the deal, and then voted for the Dominion merger anyway.

And it’s a good thing we did too. Because while the SC-PSC was too cowardly to stop Dominion’s takeover, now people know there’s a resistance afoot. Our protest was on the front page of the newspaper the next day, and mentioned in story after story that covered the Dominion deal.

By trying to silence us, throwing us out of the hearing, ignoring our evidence and demands for justice, they’ve united not only South Carolinians, but North Carolinians and Virginians in opposition. Dominion is already facing blow back in court over their Atlantic Coast Pipeline (the judge actually quoted the Lorax in smacking down the pipeline). And Virginia regulators are beginning to question why Dominion needs to charge ratepayers so much, if they’re making so much profit.

A resistance is building all across the SouthEast – to Dominion and all the oppressors. The same day we spoke out in South Carolina, Cherri Foytlin of the L’eau est La Vie camp had a tense exchange with South Carolina Regulators in Louisiana — so tense one of them knocked over a table backing away from her righteous anger. As the song says, they tried to bury us, but they didn’t know we were seeds.

People in the South are rising up. So far, the corporate polluters and pipeline builders have been able to buy, cheat and steal enough power to keep us bottled up. But the day is coming when that may not work anymore.

But you don’t have to take my word for it. Here’s the video where Elaine interviews some friends as we were arriving at the meeting. You can also get a good look at the dishonest Dominion lawyers, PSC commissioners and other various villains who did us wrong:

After that we headed into the hearing room and it was show time. Skip to about 11 minutes into this video (unless you want to listen to the SC-PSC congratulate itself on working hard to steal money from some of the poorest ratepayers in America with the help of one of the richest companies in the Southeast) to see the protest action, which made it onto the front page of the local paper the next day and was mentioned in numerous articles about the merger that evening and over the weekend.

This part might be the most crazy-making since Ervin tries to convince us he’s on our side, AND that we’re the problem (not him) at the same time. He also (dishonestly) claims he hasn’t made up his mind just a few minutes before he let us get thrown out in the rain, then went back in the hearing room and voted for the deal. Last chance – act now to stop Bernard McNamee!

If you’re one of the more than 27,000 people who have already signed on to our public call to stop Bernard McNamee, Thank you. (if not sign here) But now I need your help to delay, and possibly derail McNamee’s nomination.

Many of you have already called the Senate Energy Committee to opposed McNamee (thanks again!), but new evidence has come to light and the Democrats on that committee are asking to delay McNamee’s vote on Nov. 27th.

Here’s the gist:

In between stints at the Department of Energy, McNamee worked for a right wing thing tank funded by the Koch brothers and Exxon called the Texas Public Policy Foundation (TPPF). In that speech McNamee falsely claims renewable energy “screws up” the grid and environmental groups want to “return us to … administrative tyranny.” TPPF tried to delete the video, but some enterprising reporters dug up a copy, and a pro-renewables think tank released the whole thing last week while the Senate was on Thanksgiving recess.

Now, the Democrats on the Senate Energy and Natural Resources Committee (SENRC) say they need time to review this new evidence and ask McNamee questions about it before they can vote. 

The whole thing is so damning that even Republican former FERC officials and conservative lawyers say that it should disqualify McNamee, but Lisa Murkowski, the Republican chair of the committee is pushing ahead with a vote!

Can you call the Committee at (202) 224-4971 right now and ask them to cancel the vote and reject Mcnamee’s nomination?

Not sure what to say? These can be quick calls there are two basic points you need to make:

  1. Bernard McNamee is a dangerous nominee – he’s corrupt, unqualified, a climate-denier and part of Trump’s plan to force ratepayers to bail out coal and nuclear power. His nomination should be withdrawn and this committee meeting to vote on him should be canceled.
  2. If the hearing proceeds, Senators MUST vote NO on his nomination, and must ensure that all votes are recorded. No unanimous consent or procedural gimmicks (that’s how we got the last three Republican FERC commissioners).

Last chance to Stop Trump’s climate-denying Energy Nominee

Donald Trump has nominated Bernard McNamee – a deeply unqualified, republican-hack, and climate-denier – to fill the vacant Republican seat at the Federal Energy Regulatory commission (FERC). The Senate is moving at “warp speed” to ram this latest dastardly, destructive nomination through.

McNamee’s confirmation hearing has been scheduled for November 15 at 10am. We’re headed to DC now with friends from Beyond Extreme Energy (BXE) to deliver more than 13,000 signatures opposing McNamee. If you haven’t signed yet, now’s the time!

Your remember Brett Kavanaugh, Trump’s anti-environment, anti-worker, climate-denying, women’s-rights-decrying nominee to the Supreme Court? Yeah, he’s been hard ot forget lately – especially since he was accused of sexual assault.

But here’s the thing: Donald Trump and his allies in Congress – they want you to forget all about Kavanaugh and his crimes (both alleged and perfectly well documented). Trump & co. are running the same play they always do when one of their own are accused of sexual assault or violence against women: they deny it, attack the accuser, and accuse anyone who says different of being part of a conspiracy.

Dr. Christine Blasey Ford is scheduled to testify and share her story of how Kavanaugh assaulted her on Thursday before the Senate Judiciary Committee. But late last night ANOTHER accusation surfaced, this time from Kavanaugh’s time in college. And Michael Avenati – the same lawyer representing Stormy Daniels, the porn-star who had an affair with President Trump – says he is representing a THIRD woman.

At 1 p.m. today thousands of our neighbors will walk out of work and school as part of a national moment of solidarity to show support for Dr. Blasey Ford and ALL survivors of sexual assault. Right now, the Senate Judiciary Committee is moving forward with a sham hearing not meant to get to the truth about Brett Kavanaugh. It’s about rushing Trump’s pet judge onto the highest court in the land before they reconvene on October 1. And that’s not a coincidence: If confirmed, one of Kavanaugh’s first decisions could be to rule that Trump is above the law, and shut down the Mueller investigation subpoena. We can’t let this happen. But there’s something nobody knows about Kavanaugh, something the Washington Post this week called a “nightmare scenario” for the constitution and our country: Whether he would use his position on the Supreme Court to rule that Trump is immune from investigation and prosecution, creating a lawless presidency with Trump in control.

Robert Mueller is actively investigating Donald Trump and his associates over whether they colluded with Russia to fix the 2016 Presidential Election. Trump’s legal team is stone-walling, refusing to let Trump be interviewed because if he does, they’re worried he’ll perjure himself, lie to the FBI or confess to a crime (as he’s already done on twitter). Mueller therefore is likely to subpoena Trump, setting up an unprecedented legal showdown that can only end at the United States Supreme Court later this fall.

But here’s the scary part –Trump and McConnell have already announced plans to fast track the Kavanaugh nomination, with initial hearings scheduled in the next few weeks. If confirmed, one of his first decisions could be to rule that Trump is above the law, and shut down the Mueller investigation subpoena. We can’t let this happen. Call (202) 224-3121. to your Senators and tell them not to allow Kavanaugh’s nomination to have a hearing or a vote.

Cracks between the FERC commissioners

I’ve been fighting with the Federal Energy Regulatory Commission (FERC) for years now. Most of the time, they seem pretty monolithic: in all the years they’ve existed, they’ve only said no to two (2) pipeline applications. And they’ve always steadfastly refused to acknowledge the damage that fracked gas does to our climate.

That’s why, for the last four years or so, I’ve been working with Beyond Extreme Energy to resist FERC, tell the Senate not to confirm their commissioners, and generally shut down this rubber stamping agency. But now, for the first time I can remember, we are beginning to see cracks develop between the FERC commissioners:

Just a few days ago, the two (minority) Democratic commissioners, Richard Glick and Cheryl LaFleur, voted to void the  FERC permit for the Mountain Valley Pipeline. There have also been news reports that the two Democrats are demanding a more thorough review of climate impacts – including one time LaFleur took it upon herself to just “do the math” without her Republican colleagues’ permission.

Without question the unrelenting pressure of our movement has had much to do with this, and we need to keep it up. FERC is still accepting public comments on their pipeline review process. And on Monday June 25, we’re going to deliver a big, noisy message to FERC’s front door. Can you support us? You can join me and our BXE friends in DC to take action on Monday, OR you can just sign this petition and we’ll deliver your name along with thousands of others on Monday.


While there have been several dissents from the Democrats over the last nine months since a quorum was restored to FERC, they have not been enough to actually stop any pipeline or permit. And Republican Chairman Kevin McIntyre has made it plain he’s more interested in ‘streamlining’ the approval process than raising new questions or rejecting pipeline applications.

But while we’re not yet on pace to truly reform or “fix” FERC, I do think there’s reason to be optimistic in this moment. The recent comments from Glick and LaFleur show that our pressure has changed some minds already. And we know from past experience that when we show up in force to shut FERC down, commissioners often scurry for the exits, or even retire altogether. If we can force one more commissioner to change their position, or step down and replace them with someone who takes climate change seriously, we’ll have a majority. And THAT is worth fighting for.

Sign here to Fire Pruitt as head of the EPA

It’s past time to fire Scott Pruitt, Trump’s head of the EPA. Whether he’s tearing apart climate change regulations or making it easier to spread toxic pesticides, Pruitt stands out as the most dangerous, and effective, members of Trump’s cabinet.

Fire Pruitt to save the EPAYour Representative can demand that Pruitt resign, and even fire him using the same impeachment process as for a President. But they won’t act unless and until we demand it.

That’s why we’ve teamed up with a host of other groups to demand Congress take action NOW. Will you sign on in support so we can deliver your name to Congress while the headlines are still fresh?

Pruitt’s been under fire for months over his bigoted, corrupt, and hurtful administration of our nation’s top Environmental Agency. But in the last week, it’s gotten really intense. The news has been so bad in the last week that when I confronted Republican Chair of the House oversight Committee Trey Gowdy (SC) — he of the Benghazi witch hunt — if he’d ask Pruitt to testify in his on-going investigation, Gowdy said “I’m not sure he’s going to make it that long. It gets worse every time there’s a report in the news.” (Scroll down to see the video my friend Elaine recorded)

Gowdy is already investigating Pruitt over reports that he has traveled first class on multiple trips. New scandals involve Pruitt giving hundreds of thousands of dollars in special raises to his favorite staff, in direct contravention of Whitehouse rules – and possibly lying about it in an on-camera interview with Fox news. That has had Congress seething and democrats, at least, demanding investigations. Pruitt is also under fire for getting a special deal from veteran D.C. lobbyists and longtime campaign contributors for a $50-a-night Capitol Hill Condo rental.

We’ve already seen that Trump will fire senior cabinet officials if they get caught in too big a scandal, or cross him publicly. Remember when Tom Price was fired for wasting taxpayer money on travel?

But Trump has already tweeted his support of Pruitt. And, even more frightening, is said to be considering Pruitt as a replacement for Jeff Sessions as Attorney General. Sessions, remember, has recused himself from the Russia investigation. But Pruitt is under no such constraints – and might immediately fire Robert Mueller or otherwise tamper with that on-going investigation in exchange for Trump overlooking all these scandals and promoting him to our country’s top law enforcement official. We simply can’t let that happen. Congress needs to take action, now.

National Dream Act Day of Action Feb 7

You probably remember, less than a month ago, when all but 16 hard-line Dream Heroes in the Senate (not-coincidentally some of our most reliable votes on climate change) voted to re-open the government. They did so based on a promise from Mitch McConell and Donald Trump allow a vote to protect Dreamers before February 8.

This week, the bill for that bad bet comes due. Tomorrow is the 8th and no vote on the Dream act has been scheduled. The Government runs out of money, again, this Friday and we’ve made no progress.

As we explained last timethis Dream Act vote is a critical litmus test  for climate change.

It’s also clear that we can’t trust most of the “deals” that have been offered by Donald Trump and Mitch McConnell in recent days. McConell has already broken his promise by not scheduling an up or down vote on immigration, and today’s proposed two year spending plan does nothing to protect Dreamers — giving us us even more reason to distrust him.

Trump’s plan is even worse. He’s actively calling for a government shut down unless Congress gives him a racist immigration plan that a Washington Post analysis confirms will mostly have the effect of making America Whiter, Older, and more poor.6 It’s no surprise that President “shit-hole” isn’t a reliable negotiating partner. But that’s why we need Republicans and Democrats in Congress who claim to agree on immigration (just like many of them claim to agree on the need for climate action) to do their job and VOTE on the issue.
